Crypto.com fined $3.1 million in the Netherlands for operating without registration

Crypto.com spent around two years operating in the Netherlands without bothering to register as required by the Dutch central bank — or pay the supervisory fees they were supposed to be paying. On October 2, 2023, the central bank imposed a €2.85 million (US$3.12 million) fine on the company for the period of unlicensed registration. The company had registered with the regulator in July of that year.

The fine was announced in March 2024, and Crypto.com said it had appealed the penalty.

Crypto.com was hardly the first exchange to fall afoul of the regulator: Binance was fined $3.35 million in July 2022 for the same, and Coinbase was hit with a $3.6 million for the same in January 2023. Binance later shut down their Dutch operations after failing to obtain a license.

Crypto founder loses over $250,000 to crypto scam

Bryan Lawrence, the leader of a crypto project called Glow Token, recently shared that he'd fallen victim to scammers impersonating employees of the Crypto.com exchange. Lawrence said that scammers promised to list Glow Token's FLARE token in exchange for more than $250,000 in "security deposits". Crypto.com later contacted Lawrence, asking him to stop falsely claiming that his token would be listed on Crypto.com, and alerting him to the apparent scam.

Lawrence is now suing Crypto.com, although this may be challenging given they apparently weren't behind the scam. Lawrence has also said that he has sold his house to pay for legal costs.

Financial Times alleges Crypto.com is trading against its own customers

A report out of the Financial Times alleges that the Singapore-based Crypto.com exchange runs proprietary trading and market making teams. This is a controversial activity — though not uncommon in the crypto world — because of the conflicts of interest that are introduced when these functions are combined with those of an exchange. Speaking to CNBC about similar activities by other exchanges, US SEC chair Gary Gensler said, "These trading platforms, they call themselves exchanges, are commingling a number of functions. In traditional finance, we don't see the New York Stock Exchange also operating a hedge fund, making markets."

Sources cited by the FT allege that Crypto.com made "absolutely dramatic sworn statements that Crypto.com was in no way involved in trading" to other trading houses, and claim that employees were asked to lie about the existence of internal market makers. Crypto.com has refuted these allegations, and acknowledged that they run a market maker.

"This is not a controversial practice," Crypto.com said about the controversial practice.

Crypto.com to shut down institutional trading in the US

Singapore's Crypto.com has announced it will be imminently shutting down its institutional exchange service in the US, citing "limited demand from institutions in the U.S. in the current market landscape". The firm will continue to serve retail customers in the country, however.

Binance suspends USD bank transfers

Binance announced that they would be "temporarily suspending USD bank transfers" with two days notice.

This comes in the wake of various crypto exchanges — Binance included — appearing to have difficulties with banking. On January 21, Binance announced that users wouldn't be able to use SWIFT for transfers below $100,000 via Signature Bank. Meanwhile, Crypto.com's Lithuanian payment processor, Transactive, has faced a crackdown from the Lithuanian banking regulator leaving Crypto.com users without access to Euro-denominated deposits and withdrawals.

Auditing firm cuts ties with crypto clients, deletes Binance's "proof of reserves" report they issued days prior

The accounting firm Mazars Group has ceased working with cryptocurrency clients, including Binance, KuCoin, and Crypto.com. A statement from the firm attributed their decision to "concerns regarding the way these reports are understood by the public".

On December 7, a branch of Mazars Group had published a "proof of reserves" report for Binance — though it only accounted for Bitcoin, and did not reflect liabilities for Binance's lending product. On December 9, Crypto.com also published a "proof of reserves" report that had been produced by the firm.

As of December 16, the Binance audit — which had been hosted on Mazar's website — had been deleted.

"Proof of reserves" reports have been offered by various cryptocurrency exchanges in lieu of proper audits, but have reasonably failed to reassure many customers of those exchanges. These reports do not involve the scrutiny that would be applied by a full audit — they only reflect a snapshot of assets at a point in time, and do not show a firm's liabilities.

Crypto.com CEO admits company accidentally sent 320,000 ETH ($416 million) to another crypto exchange a few weeks prior

A Twitter user posted Etherscan screenshots showing a massive flow of crypto from the Crypto.com cryptocurrency exchange to another exchange, Gate.io. "Anyone know why Crypto.com would send 320k ETH (82% of their ETH today) to Gate.io on October 21?", they wrote. "And why Gate.io would send back to Crypto.com 285K ETH 5-7 days later?"

Crypto.com's CEO, Kris Marszalek, replied: "It was supposed to be a move to a new cold storage address, but was sent to a whitelisted external exchange address. We worked with Gate team and the funds were subsequently returned to our cold storage." He later clarified that all of the funds were returned.

Twitter users, reasonably, reacted in horror at the revelation that the platform had accidentally sent such a substantial portion of their funds elsewhere in a careless mistake, and that such a monumental mistake was even possible. They were lucky that they erroneously sent the funds to another exchange, and one who agreed to return the funds.

This is not the first time Crypto.com has erroneously transferred funds; in August of this year, they sued a woman to whom they'd accidentally sent $7.2 million that wasn't hers.

Crypto.com reportedly lays off hundreds more employees than they announced, tries to hide it

In mid-June, Crypto.com announced they would be laying off 260 people, or around 5% of their employees. However, The Verge has reported that "hundreds more" employees were quietly laid off since then. They report: "Crypto.com has been trying to limit knowledge of the extent of these departures even within the company, with CEO Kris Marszalek refusing to answer a question about the total figure in a recent employees-only town hall meeting."

Marszalek also tried to discourage employees from leaking about the layoffs, saying at a company town hall: "A number [of employees laid off] makes for a great headline, it's a great thing to gossip about. [But] as co-owners of this company, you should ask yourself, 'is it in my interest for this number to be out there?'" One employee told The Verge that this did nothing to assuage their fears about the layoffs, and that "[it felt like] I got told to shut up and get back to work. It felt insulting."

One recent review on Glassdoor claims that Crypto.com had laid off "more than 1,000 employees", and alleged that "They've removed the company directory so we can't see the numbers go down."

Crypto.com and BlockFi announce layoffs

On June 10, Crypto.com announced they would be "making targeted reductions" of 260 people, amounting to around 5% of their workforce. On June 13, BlockFi announced that they were in "the gut wrenching position of needing to reduce our headcount" by around 20%. BlockFi has around 850 staff, suggesting they plan to lay off 170 people.

These announcements followed a June 2 layoff announcement by Gemini and the announcement by Coinbase that same day that they would be rescinding already-accepted job offers.

Rumors of a downturn across the tech industry more broadly have been swirling for several months, but crypto companies appear to be being hit particularly hard as they simultaneously endure "crypto winter".

Crypto.com reverses some Luna trades, offers $10 consolation prize

One of the features of crypto that its proponents sometimes highlight is that transactions can't be reversed. This, of course, is not true when making trades on exchanges like Crypto.com, who can largely do whatever they want with the wallets they maintain and the coins they keep track of on users' behalf.

On May 13, the company announced it would be reversing transactions made during an hour-long period on May 12 when "users who traded LUNA were quoted an incorrect price". Some users were able to profit off the discrepancy, but later were told that their transactions were being reversed. Crypto.com offered $10 in CRO, their cryptocurrency token, "for the inconvenience caused". Crypto.com halted Luna trading after discovering the issue, and it remains halted as of May 13.

The issue sounds quite similar to issues that affected various defi projects around the same time. Several projects who failed to account for unexpected Luna price data coming from blockchain oracles including Chainlink suffered major attacks.
